According to the court documents, attorneys have filed a lawsuit following a fatal drunken driving accident in San Antonio. The suit claims that Jorge Badillo, Jr. died due to the over-service of alcohol to an already intoxicated patron, who was then allowed to walk out of the bar and drive home.

A patron at La Vikina Bar & Grill was served alcohol and continued serve it when it should have been very apparent that they patron was intoxicated on or around the night of Oct. 26, 2012, according to the lawsuit.

It is alleged that the patron was clearly intoxicated to the point that she presented a “clear danger” to herself and others. The patron then, allegedly, left La Vikina purportedly traveling the wrong way on Highway 151 and struck Jorge Badillo, Jr.’s vehicle head-on. Badillo dies as a result of the injuries that he sustained in the accident.

“While the driver is a large focus of the lawsuit, this suit also recognizes the potential danger of bars and restaurants over-serving their clients,” stated the attorney on the case.

He continued on to describe the bar scene. “a dram shop suit (a suit which asserts both the liability of the driver and the alcohol provider) puts the bar on notice that their practices must change. In one instance it may be a lack of training, in another it may be a push for profits, but at the end of the day, patron safety must be the top priority.”

The suit is seeking both survival damages for the victim’s death and wrongful death, as a result of the accident.
