After years of fighting, a woman who suffered severe injuries due to a collision with a big box truck is finally getting the money owed to her. Ms. Chung Wu Hsu was driving in the city 1998 Lexus ES300 when the big-box truck hit the broadside of her car. Martinez Diaz, the driver of the truck ran a red light after falling asleep at the wheel. As a result of the crash, Mrs. Hsu, who is 62-years-old, suffered from a brain injury, broken ribs, and serious trauma to her spine. Due to the carelessness of Diaz, and his employer, Mrs. Hsu will never be the same.

Mr. Diaz admitted at the scene that he ran the red light and was “half-asleep” while driving. He was issued a fine, which he paid. However, the defendants fought liability for years. Even after Mrs. Hsu offered to settle the case for less than $1 million, they continued to fight her claims. However, this turned out to be a mistake on the part of the defendants. The jury delivered a verdict in favor of Mrs. Hsu. The total amount awarded was $6,126,000. However, since the defendants failed to accept the plaintiff’s offer to compromise for $1 million, the verdict is subject to prejudgement interest at 10% per year. After the total interest, fees, and costs, the total award will be over $7,300,000.
